BC PNP Strategic Projects - Requirements for Corporate and Employee Eligibility

The BC PNP Strategic Projects program outlines stringent criteria for both the participating corporation and its employees.

Corporate Eligibility Requirements:

  1. Financial Standing: The corporation must exhibit exceptional financial health, uphold sound business practices, and boast successful operations in nations outside of Canada. These operations should align with the prospective branch or facility to be established in British Columbia.
  2. Investment Opportunities: The company must identify investment prospects that not only enrich its business but also lay a robust foundation for commencing and sustaining operations in British Columbia.
  3. Qualified Staff: The company must substantiate the seniority and competence of the employees earmarked for deployment to British Columbia, ensuring their capability to proficiently establish and manage the business within the province.
  4. Equity Investment: A minimum equity investment of CAD 500,000 or more is required to establish, acquire, or expand operations in British Columbia.
  5. Job Creation: The establishment of a new branch or facility must generate employment opportunities, with a mandate to create three or more jobs for Canadian citizens or permanent residents for each foreign staff member recruited under the program.
  6. Company Size and Revenue: While there are no specific stipulations regarding minimum company size or revenue, successful applicants often hail from companies with a minimum of 150 employees and an annual revenue exceeding CAD 20 million.

Employee Eligibility Requirements:

Foreign staff members slated to relocate to Canada to establish and manage the business must meet the immigration eligibility criteria set forth by Immigration, Refugees, and Citizenship Canada (IRCC). This entails ensuring that employees do not fall within any of the following categories:

  • Individuals prohibited from entering Canada.
  • Those unlawfully present in their current country of residence.
  • Individuals legally in Canada but facing a loss of status.
  • Persons working in Canada without proper authorization.
  • Individuals with pending refugee claims in Canada.
  • Individuals are subject to removal orders within or outside of Canada.

BC PNP Strategic Projects - Application Process

For prospective corporations seeking to apply for the Strategic Projects category, adherence to the delineated steps is imperative:

  1. Conduct an Exploratory Visit: Senior executives of the company are encouraged to embark on a visit to British Columbia, acquainting themselves with the diverse array of business opportunities within the province. While not obligatory, such a visit aids in providing valuable insights into the local business landscape.
  2. Proposal Discussion and Approval: Upon deciding to pursue the BC PNP Strategic Projects category, companies are mandated to liaise with the BC PNP. This engagement offers an avenue for representatives to garner deeper insights into the program and deliberate on their business proposal before initiating the formal registration process. Detailed Proposal Requirements:

During the registration process, corporations are obligated to furnish comprehensive details, encompassing:

  • Company particulars such as founding date, detailed business operations, sales revenue figures, and staff count.
  • Information pertinent to the envisaged business venture or acquisition in British Columbia.
  • Articulation of the nexus between the new British Columbia business and the company’s existing core operations.
  • Assessment of the commercial viability of the new business venture.
  • Projections concerning the new business’s annual revenue.

The BC PNP reserves the right to solicit further information during their preliminary assessment. Prospective corporations are strongly urged to furnish all relevant details to facilitate a seamless registration process. Additionally, a registration fee of CAD 300 is requisite for processing the registration request.

  1. Registration: Corporations should proceed to register on the online system, signaling their intent to apply for and secure Canadian work visas for their staff members. This entails the submission of:
  • A comprehensive company profile.
  • Details outlining intended investments in the British Columbia economy.
  • Qualifications of key staff members who will apply for a Canadian investor visa.

At this juncture, the company is required to remit the $300 registration fee.

  1. Receipt of Invitation to Apply: Following a review of the submitted registration information, the BC PNP will ascertain the eligibility of the foreign company to proceed with its application. Upon receipt of an invitation to apply, the company must submit a complete application within 90 days from the date of issuance of the invitation.
  2. Completion and Submission of Application: Companies deemed eligible for the BC PNP Strategic Projects program will be contacted to finalize a comprehensive application. During this phase, both the company and the staff members intending to relocate to Canada must complete forms and furnish relevant documents. Additionally:
  • A corporate application fee of CAD 3,500 must be remitted at this stage.
  • An application fee of CAD 1,000 per staff member applying under the program is also applicable.
  • The BC PNP will conduct a thorough assessment of the completed applications and may request further information or documents if necessary.
  • Successful applicants will be invited to Vancouver for an in-person interview.
  1. Sign Performance Agreements: Upon a favorable decision regarding the application, the company is obligated to sign a Performance Agreement with the province of British Columbia. Likewise, all approved vital staff members are required to sign corresponding agreements.
  2. Receive Temporary Work Permits: The BC PNP will issue a work permit support letter to each approved key staff member. Armed with these letters, individuals can proceed to apply to the Immigration, Refugees, and Citizenship Canada (IRCC) for a Canada work visa. After signing their performance agreements, staff members must arrive in British Columbia within six months from the issuance date of their work permit support letters. Within two months of their arrival, they are required to complete an arrival report form for submission to the BC PNP.
  3. Establish Business and Obtain Provincial Nomination: Upon receiving their work permits, staff members can proceed to Canada and submit their arrival report form to the BC PNP. Simultaneously, the corporation must furnish its final report to the BC PNP, substantiating compliance with the conditions outlined in the Performance Agreement. The BC PNP may conduct interviews and site visits to verify the accuracy of the report’s contents. Upon satisfaction of all conditions and terms, staff members in British Columbia will receive a nomination for permanent residency.Subsequently, they must apply for permanent resident status with the IRCC within six months of receiving this nomination.
  4. Application for Permanent Residence: All qualifying senior employees of the company are eligible to apply for permanent residence with the IRCC within 180 days following receipt of a provincial nomination.
