Typically, spouses can apply for a SOWP once the international student's classes have commenced. Many individuals choose this route to expedite and streamline the study permit application process.

Open Work Permit for International Student's Spouse

An open work permit, being non-specific to any job, is also applicable to international students enrolled in the post-graduate work program or the spouses of international students.

Updated Eligibility Criteria:

For an international student to apply for an open work permit for their spouse, they must meet the following criteria:

  • Hold a valid study permit.
  • Be a full-time student pursuing a master’s or doctoral degree at a public university or college, a private college in Quebec, or a private Canadian institution authorized to confer degrees.
  • The master’s program must have a minimum duration of 16 months, as per new restrictions introduced by Immigration Minister Marc Miller on September 18, 2024. This excludes spouses of students in shorter master’s programs or certain other academic and professional programs.
  • Applicants must provide additional documentation, including:
    • A valid letter of acceptance from a designated learning institution (DLI) or proof of enrollment.
    • Academic transcripts for current programs.
    • Proof of participation in eligible pilot programs (if applicable).

Validity of Spouse Open Work Permit:

Open work permits issued to spouses of international students typically have the same validity length as their partners’ study permits. This rule remains unchanged, though new restrictions limit SOWPs to spouses of students in eligible programs only.

Steps to Apply for a Spousal Open Work Permit

Here are the steps to apply for an open work permit for the spouse of an international student in Canada:

1. Initiate an Online Application for a Work Permit

Begin by visiting the Immigration, Refugees, and Citizenship Canada (IRCC) website to start the application for a work permit. Download the application package and complete the IMM 5710 form provided.

2. Gather the Necessary Documents

Collect the documents listed in the Document Checklist from the application package. These documents include:

  • Digital photographs of the spouse.
  • Copies of the spouse’s passport.
  • A copy of the student’s study permit.
  • A copy of the marriage license or certificate.
  • Proof that the student is enrolled in an eligible program lasting at least 16 months.
  • Proof of the spouse’s relationship with the student.
  • Any additional evidence required under specific pilot programs.

3. Pay the Application Fee and Submit the Application

Proceed to pay the CAD 255 application fee online. Print the receipt for this payment and include it with the application before submission.

Fee Update (Effective December 1, 2024):

IRCC has increased the fee for restoring worker status, which now applies to spouses of international students seeking to reapply under certain conditions.

  • Restoration of Worker Status: Increased to $394.75 from $384.00 (2.80% increase).

IRCC may reach out if any additional information or documents are required from the spouse. Upon approval, the spouse will receive their open work permit document by mail.
